Is CBD Oil Legal In Ecuador?

According to the 2008 Constitution of Ecuador, the government does not see drug consumption as a crime but merely as a public health concern. Unlike most of North America, Ecuador does not carry too many harsh punishments for domestic drug offenses; instead, officials apply their efforts to reducing international drug trafficking, distribution, and crime syndication.

Is CBD Oil Allowed In Ecuador?

Ecuador has a lax attitude towards individual drug users, specifically those who use high THC compounds like hash. Individuals are allowed to have up to ten grams of high THC marijuana strains on them without any legal repercussions. Those caught smoking in public are usually let off with a warning.

As of January 2019, Ecuador officials have started the process of legalizing the presence of different cannabis varieties. Congress is fighting to legalize the production, distribution and sale of high THC marijuana for medical purposes. Under the new program, medical practitioners could prescribe marijuana and growers could officially get licensed to manufacture it. The Health Ministry would be in charge of determining the sets of conditions that would justify medical grade, high THC hemp prescriptions.

The new law would allow for CBD with less than 1 percent THC and over ten percent active cannabinoids to be marketed for medical purposes.

Confusingly for some consumers, Ecuador approved a law in 2015 which decriminalized THC and hemp use. However, the law still penalized sellers who marketed products containing CBD and THC. Additionally, even though the 2015 law legalized consumption of small amounts of hash, consumers could still be charged with micro drug trafficking, which is punishable by up to three years in prison.

Congress officials are hopeful that the new bill will pass with little resistance in the upcoming legislative session. The public and many health officials have been pushing for increased deregulation of cannabis products over the past five years. As research comes out touting the benefits of CBD, it becomes harder for the Ministry of Health and governmental officials to ignore the public will.

Unlike opiates or over the counter drugs, CBD is non addictive and non psychoactive. Users report many consistent benefits of regular CBD use, including:
