In 2018, congresswoman Zoila Volio sponsored a new bill dubbed “Hemp Production Law for Medical and Industrial Purposes”, which sought to allow for growers to formally industrialize the cultivation of hemp.

Historically, Costa Rica was an agricultural country known for its banana and sugarcane plantations. Experts believe that a clear, consistent legal framework for hemp production could create a tremendous surge in the local economy. Legal hemp requires the development of research facilities, processing centers, and spurs academic research.

The new legislation would involve two agencies to systematize the licensing of hemp producers in the country. The Ministry of Public Health Medicine and the Ministry of Agriculture would work in tandem to fully regulate the industry.

Currently, CBD products in Costa Rica are technically legal as long as they contain less than 0.3 percent THC content. However, there are many arguments over which products should be considered food, prescribed medications, or over the counter supplements.

In order to fully realize legal CBD in the domestic marketplace, Costa Rica has to contend with and unravel years of prior legislation regarding food and safety measures. As other countries around the world legalize hemp production, Costa Rica may be forced into a position to quickly deregulate the substance to avoid international battles over imports and travel restrictions.

Overall, consumers and businesses feel comfortable consuming, selling, and distributing low THC hemp extracts all across the island. CBD has popped up in specialty shops, cafes, restaurants, and retailers over the past five years. It’s recommended that, for now, consumers stick to CBD products with no trace of THC because even slight amounts can qualify the substance as a medical treatment.
