Is CBD Legal In The US Virgin Islands?
Few had ever heard of CBD, also known as cannabidiol, until a 2013 CNN documentary featured its claimed healing powers. Many users of CBD have been claiming it has the ability to positively impact users’ mental and physical health but as a product of hemp, it has been illegal in the US until 2014. Since then, entrepreneurs have been infusing every product under the sun with CBD: tinctures, oils, capsules, baked goods, and even dog treats. CBD Oil Finally Available
In 2014, the federal farm bill deemed hemp legal to grow and market. This federal law was later reiterated even more strongly by the 2018 Farm Act, which officially declassified hemp as a controlled Schedule I substance and instead dubbed it an agricultural crop.
Since then, the states and US territories have been scrambling to find out about CBD, its impacts, and if it can be legally sold in edible products. The FDA and DEA went a long way to confuse the issue by, just days after the Farm Act’s passage, claiming that CBD was still not cleared to be added to food and drinks.
In January of 2019, the US Virgin Islands became one of the last territories to finally allow the sale, production and distribution of CBD infused treats. Farmers have since fought to procure certifications to grow hemp in the territory, eager to hop onto the successful cash crop.
“I want to make sure locals don’t get shut out of the business,” one hemp advocate claimed at the National Organization for Reform of Marijuana Laws (NORML) at an event in the Virgin Islands.
Currently, health advocates are attempting to get stricter regulation on the sale of CBD products. Some vendors, spurred by the void in legal restrictions, perform inadequate labeling, crop testing, and make completely false claims about their products. There is very little enforcement on the island towards vendors who market CBD as a cure all solution for every ailment.
