Is CBD Legal In New Mexico?

In the “Land of Enchantment”, also known as New Mexico, CBD products can be purchased without a prescription. Even so, there is still confusion that surrounds the legality of CBD products.


There is a lot of confusion surrounding the difference between CBD and THC. Both CBD and THC are compounds that are found within the cannabis plant. 

  • THC, which is short for tetrahydrocannabinol, is a psychoactive compound that creates an intoxicating sensation for those who consume it.
  • THC can be found in marijuana.
  • CBD, which is short for cannabidiol, is extracted from industrial hemp, also known as Cannabis Sativa L
  • CBD is non-psychoactive and will not cause someone to test positive on a drug test.
  • The Cannabis Sativa L plant contains what is known as Non-Detectable THC.

Research claims to have found that CBD has potential as a useful tool in treating inflammation and pain conditions. Studies also claim to have shown that CBD can be used in the treatment of many of these conditions:

  • Arthritis
  • Muscular Sclerosis
  • Back or Muscle Spasms
  • Insomnia
  • Inflammatory Conditions
  • Skin Conditions

New Mexico Law And CBD

The Farm Bill of 2014 was signed by President Barack Obama. This law legalized the cultivation of commercial hemp for research.

In 2018, the Farm Bill was expanded by President Trump. This bill was extraordinary because it removed commercial hemp from the national controlled substances list and classified it as an agricultural product, a sharp change from past policy.

HM 47 was a memorial that requested that marijuana and industrial hemp become separated from one another. HM 47 also requested that further research be done on the cultivation of industrial hemp.

Finally, in 2019, New Mexico passed laws specifically legalizing hemp growth and products. Cannabidiol is finally legal for sale in New Mexico, specifically and definitively. 

The Bottom Line

Some states have surpassed others during this fight for acceptance. New Mexico allows its residents to freely purchase CBD products without a prescription, depending on the above stipulations. Though complicated, this can be great news for anyone who has an interest in using CBD-derived products for health concerns.

The laws regarding CBD seem to be ever-changing. Those who currently use or wish to use CBD products in the future need to stay up to date with the current CBD laws in their home state.A
