Is CBD Legal in Belgium?

Unfortunately the answer to this question is no, it is not legal even though Belgium is often regarded as one of the most progressive nations in Europe. A surprising answer to be sure but read on to see why this is.

The History of Laws in Belgium

Surprisingly, the drug laws in Belgium haven’t changed in decades. In fact, a drug law was created in 1921 that still stands today. That particular law expressly prohibits the use of any type of cannabis. Despite the fact that CBD is derived from the hemp plant, according to the government of Belgium there is no distinction between CBD and THC or marijuana. This is rather interesting considering the fact that Belgium routinely exports hemp in large quantities. 

Nevertheless, those who live in the country are not allowed to legally use CBD products, largely because officials in the country still consider it to be a product that may have some degree of THC present. THC is what gives you the high when you consume marijuana. However, high quality CBD products do not contain any THC.

Regardless of that fact, it appears that officials in Belgium have decided to ban all substances as opposed to regulating the CBD industry.

Online Sales

One of the things that makes the debate concerning the legality of CBD in Belgium so confusing is that many websites state that it is perfectly legal throughout the country. This is something that a lot of people rely on and in many cases, they are being given inaccurate information. 

The truly concerning thing is that possessing CBD or even ordering it could potentially get people into trouble. There are a lot of people that order these types of products online because it’s simply more convenient to do so. When they are being told that it’s legal to order CBD products and the package is then intercepted by Customs, the individual who ordered it runs the risk of getting into legal trouble for something they probably thought was perfectly legal to do. In some cases, these websites are not researching the legality of CBD use thoroughly enough for the area in question. Whether the misinformation is a direct result of a lack of research or a blatant disregard for the laws in order to boost sales, it is the customer who could potentially suffer.

When it’s all said and done, it’s best to follow the laws in Belgium. 

That means that right now, even CBD oil is illegal. Even if the product has been purchased online through a reputable company that’s based in an area where CBD is legal, it is not legal to consume it or even have it in your possession anywhere in Belgium at this time.
