Is CBD Legal In American Samoa?

In mid July of 2019, the High Court of American Samoa ruled that possession of CBD was illegal. This policy decisions came as a shock to many users on the island who rely on CBD products to help regulate their mental, physical, and emotional well being. Many thought that the Farm Bill of 2018, which federally legalized hemp, would have a more significant impact on the island’s policy.

The court case came about because a man was found in possession of CBD was arrested. The case escalated all the way up to the highest court in American Samoa, which stated: “We consider CBD to be a product … prepared from illicit substances. CBD oil is illicit regardless of whether or not it is psychoactive.”

Despite the court’s ruling, hemp extracts like CBD are still technically legal in American Samoa even when they contain a small amount of THC, the psychotropic substance found in controlled substances. Users are currently very uncertain of their continued access to legal CBD and it seems to have become even more restrictive over the past year.

On the island, it’s not uncommon for legal officials to stop consumers caught with hemp extracts or CBD infused products on the street. Port authorities have even barred the shipment of CBD oil into American Samoa, worried that the substance is illegal. In this way, American Samoa is very unlike the other United States territories, which typically have more lax policies concerning the supplement.
