History of CBD and Cannabis In – Maryland

It’s no secret that the laws surrounding cannabis in the United States are confusing. In some cases, the laws seem to contradict one another, even within the same state. If that’s not enough to get the best of you, think about how different the state and federal laws are. Even when cannabis is legalized within a certain state, it isn’t necessarily legal at the federal level. 

This leaves a lot of questions on the part of the consumer. Some of those questions even concern the possibility that marijuana deemed legal in a particular state will ultimately be determined to be illegal because the federal government classifies marijuana in the same category as cocaine and heroin. Your head is probably spinning by now. That being said, it’s important to consider the laws surrounding cannabis in the state of Maryland.

Is Cannabis Legal in Maryland?

Not surprisingly, this is a difficult question. There is no black and white answer that fits everyone across the board. Suffice it to say that cannabis is legal under certain circumstances, but not in others. If you think that seems about as clear as mud, you’re definitely not alone. 

The legality of cannabis in Maryland is determined by the amount you have in your possession and the reason you’re using it. It also depends on the type of cannabis product you have. More will be discussed about that below. 

As for the legality of marijuana in the state, there are a lot of variables that must be considered. First and foremost, you must have a verifiable medical need in order to legally possess marijuana. The state does have a medical cannabis program in place so if you want to use marijuana legally, you have to go through the proper channels. Recreational marijuana is illegal. However, if you are caught with only a small amount and you can prove that you have a medical condition that may be helped by marijuana, you might be able to get the charges dropped.

What About CBD?

So far, CBD has not been targeted by lawmakers. It comes from cannabis, so certain states have begun targeting CBD use as well as marijuana. Thankfully, that hasn’t happened in Maryland yet. The Farm Bill of 2018 made it legal to produce crops of hemp for industrial use. This is where the majority of CBD products come from. In fact, the only marijuana-based CBD products are purchased at licensed dispensaries. While those products must be purchased and used by someone who can legally use marijuana, the CBD products made from hemp can be purchased legally by anyone.

There is no doubt that laws concerning marijuana and CBD are confusing. This isn’t the case only in Maryland, but throughout the United States and in many other countries. As time passes, it’s likely that some of these laws will become more clear. Until then, the best thing you can do is find out as much as you can regarding the laws for the location in which you live and then go from there.
